End-user licence agreement
Effective August 28, 2026
This agreement covers the Mountain Landscapers Quoting Portal (the "software"), the private application at quotes.mtnlandscapers.com. Using the software means you accept these terms. If you have a signed agreement with Mountain Landscapers, that agreement controls wherever it differs from these terms.
Our privacy policy explains what the software collects and who handles it, and forms part of this agreement. Our terms of service cover estimates themselves.
Who this software is for
The software is private business software, not a public product and not offered for sale. It is licensed for use by:
- Mountain Landscapers personnel — office staff, estimators and crew leads, who sign in with an account issued to them; and
- Mountain Landscapers customers, who open a private link to view, sign and pay for an estimate and to follow the progress of their job. No account is created for a customer, and the link is their access.
It is operated by Mountain Landscapers, LLC and was built and is maintained for us by Salt Services LLC.
Licence
Subject to these terms you are granted a personal, non-exclusive, non-transferable, revocable right to use the software for Mountain Landscapers business, for as long as you are authorised. The software itself, its design and its pricing logic remain the property of Mountain Landscapers and Salt Services. Nothing here transfers ownership of it.
Your own business records — your estimate, your signed contract, your job — remain yours.
What you may not do
- Share your login, password or PIN, or let someone else use your account.
- Attempt to reach data your role is not permitted to see, or work around the limits the software places on your account.
- Copy, decompile, reverse-engineer or resell the software, or use it to build a competing product.
- Use it to store anything unlawful, or to enter records you know to be false — hours, receipts and signatures recorded here are business, payroll and tax records.
- Use automated means to extract data from it.
The QuickBooks Online connection
The software can connect to Mountain Landscapers' own QuickBooks Online company in order to record what jobs cost. This connection is subject to the following, and to Intuit's own terms:
- Only an administrator of that QuickBooks company may authorise it. Whoever authorises it confirms they are entitled to do so on behalf of the company that owns those books.
- Scope is accounting only. The software reads the chart of accounts, the customer and project list and the vendor list, and writes expense entries built from receipts logged in the portal. It requests no other permission.
- Access tokens are held in encrypted private storage, are never sent to a browser, and are not stored in source code.
- QuickBooks data is used only to keep Mountain Landscapers' books. It is never sold, never shared for anyone's marketing, and never used to train a model.
- The connection can be revoked at any time, from QuickBooks under Apps or from inside the portal. Revoking it stops the software reaching QuickBooks; entries already posted remain in QuickBooks as accounting records, where they can be edited or voided in the normal way.
Entries the software posts are our own records of our own costs. Reviewing them, and the accounting treatment they represent, remains the responsibility of Mountain Landscapers and its accountant. The software is not accounting, tax or legal advice.
Availability, and no warranty
We aim to keep the software available but do not guarantee uninterrupted or error-free service, and we may change or withdraw features. It is provided "as is" and "as available", without warranties of any kind — express or implied, including merchantability, fitness for a particular purpose and non-infringement — to the fullest extent the law allows.
Limitation of liability
To the extent the law allows, neither Mountain Landscapers nor Salt Services is liable for indirect, incidental, special or consequential damages, or for lost profits or lost data, arising from use of the software. Total liability arising from your use of the software is limited to the amount you paid Mountain Landscapers for the work at issue in the twelve months before the claim.
Nothing in this section limits liability that cannot lawfully be limited.
Suspension and termination
Access may be suspended or ended at any time — when someone leaves the company, when a job is finished, or if these terms are breached. On termination your right to use the software ends. Records already created are retained as described in the privacy policy; signed estimates and logged receipts cannot be deleted, because they are the evidence of what was agreed and what a job cost.
Changes
These terms may be updated; the effective date above will change when they are, and continuing to use the software means accepting the update. If any part is unenforceable, the rest still applies.
Governing law
This agreement is governed by the laws of the State of Tennessee, and any dispute belongs in the state or federal courts serving Sevier County, Tennessee. Before filing anything, please call us — nearly everything is easier to fix with a phone call.
